DRUNK DRIVING: FIRST TIME OFFENSE:

JAIL: Punished by imprisonment in the county jail 48 to 72 hours minimum, at least 48 hours of which shall be continuous, nor more than six months in the county jail.

FINE: Fine of not less than $300, nor more than $1,500.

TREATMENT: Attend Alcohol Safety School & Alcohol treatment if necessary.

DRIVERS LICENSE: The person's privilege to operate a motor vehicle shall be suspended by the department for no suspension to 1 year. The court shall require the person to surrender the driver's license to the court.

RESTRICTED LICENSE: Possible "Bread and Butter" license after service 60 day suspension.


ADDITIONAL PENALTIES:


ENHANCEMENTS:

REFUSAL: If any person willfully refused a peace officer's request to submit to a chemical test the punishment shall be enhanced by an imprisonment of at least 72 continuous hours in the county jail + 1 year additional license suspension.

COMMERCIAL VEHICLE: A driver of a commercial motor vehicle may not operate a commercial motor vehicle for a period of one year.

DEFENDANT 13-18 YEARS OLD: If committed while the person was under the age of 21 years, but 13 years of age or older, the court shall suspend the person's driving privilege for one year.

DEFENDANT UNDER 18 YEARS OLD: The term of the revocation shall be until the person reaches 18 years of age, for one year, or for the period prescribed for restriction, suspension, or revocation specified whichever is longer.

MINOR PASSENGER: If any person is convicted and a minor under 14 years of age was a passenger in the vehicle at the time of the offense, the court shall impose 48-72 minimum continuous hours in the county jail.

No Prior Pa DUI Offenses within the last 10 Years.

BAC .08% to .099%. This is an ungraded Misdemeanor with a 6 month maximum probation and a $300.00 fine. Required CRN, AHSS and possible D&A. There is no loss of license and no jail time with this particular category.

BAC .10% to .159%. This is an ungraded Misdemeanor with a mandatory 48 hour imprisonment up to a possible 6 months and a $500.00 to $5,000.00 fine. Required CRN, AHSS (Alcohol Highway Safety School) and possible D&A. The license suspension is 12 months. However there is a possibility to get an Occupational Limited License (OLL) after serving a hard 2 month suspension.

BAC 16% or higher or refusal to give a blood or breath sample or drugs in system. This is ungraded Misdemeanor with a mandatory 72 hour imprisonment up to a possible 6 months and a $1,000.00 to $5,000.00 fine. Required CRN, AHSS and mandatory full D&A. The license suspension is 12 months. Also possibility for OLL after serving hard 2 months suspension.

ARD Accelerated Rehabilitative Disposition

For 1st time offenders. Charges dismissed 1 year after classes, fines and/or community service.

License Suspension - No Suspension - 60 day Suspension depending on BAC. Eligibility for ARD is the sole discretion of District Attorney



DRUNK DRIVING: SECOND OFFENSE:

JAIL: Punishment by imprisonment for at least 90 days in county jail, but not more than 5 years.

FINE: Fine of at least $300, but not more than $1,500.

DRIVERS LICENSE: The person's privilege to operate a motor vehicle shall be suspended for one and one half (1 ½) years, depending on the BAC.

IGNITION INTERLOCK DEVICE: The court will require that a person convicted of a second offense violation of to install a certified ignition interlock device on any vehicle that the person owns or operates and prohibit that person from operating a motor vehicle unless that vehicle is equipped with a functioning, certified ignition interlock device.


Mandatory Sentencing

BAC .08% to .099%. This is an ungraded misdemeanor with a mandatory 5 days imprisonment to 6 month maximum jail sentence and a $300.00 to $2,500.00 fine. The license suspension is for 12 months. Required CRN, AHSS, D&A and Ignition Interlock for 12 months.

BAC .10% to .159%. This is ungraded misdemeanor with a mandatory 30 days imprisonment to 6 month maximum jail sentence and a $750.00 to $5,000.00 fine. The license suspension is for 12 months. Required CRN, AHSS, D&A and Ignition Interlock for 12 months. House arrest or work release at the disretion of sentencing judge.

BAC .16% or higher or a refusal. This is graded as a misdemeanor of the First Degree with a mandatory 90 days imprisonment 5 year maximum jail sentence and a $ 1,500.00 to $10,000.00 fine. The license suspension is for 18 months. Required CRN, AHSS, D&A and Ignition Interlock for 12 months. House arrest or work release (see above).



DRUNK DRIVING: THIRD TIME OFFENSE:

(Current offense date within 10 years of 3 or more convicted offenses.)

JAIL: Punished by imprisonment in the county jail for not less than 10 days. (.03)-(.16)

FINE: Fine of not less than $500-$5000.

DRIVERS LICENSE: The person's privilege to operate a motor vehicle shall be revoked by the department under Vehicle Code § 13352 for 1 year - one and one half (1½) years.

Restriction eligibility for non-commercial privilege after 12 months.

Mandatory Sentencing

BAC .08% to .099%. This is graded as Misdemeanor of the Second Degree with a mandatory 10 days imprisonment 2 year maximum jail sentence and a $500.00 to $5,000.00 fine. The license suspension is for 12 months. Required CRN, D&A and Ignition Interlock for 12 months.

BAC .10% to .159%. This is graded as a Misdemeanor of the First Degree with a mandatory 90 days imprisonment 5 year maximum jail sentence and a $1,500.00 to $10,000.00 fine. The license suspension is for 18 months. Required CRN, D&A and Ignition Interlock for 12 months.

BAC .16% or higher, refusal or drugs. This is graded as a Misdemeanor of the First Degree with a mandatory 1 year imprisonment 5 year maximum jail sentence and a $ 2,500.00 to $10,000.00 fine. The license suspension is for 18 months. Required CRN, D&A and Ignition Interlock for 12 months. House arrest or work release at the discretion of sentencing judge.
